Most commercial subcontracts include a notice requirement for change orders. This means you're required to notify the GC in writing within a specified timeframe, sometimes as short as 48 to 72 hours, that a change has occurred or that you're proceeding with work that you consider to be outside your original scope. Failing to provide timely written notice can waive your right to additional compensation even when the change is legitimate and the work was genuinely outside your contract.

This is the provision that catches concrete subs most often. The work gets done, weeks pass, and when the sub tries to submit a change order at the end of the project, the GC points to the notice provision in the subcontract and declines to pay. Courts and arbitrators frequently uphold notice requirements strictly, which means the legal protection you thought you had for that extra work may not exist if the notice wasn't timely.

The practical response is to develop a standing practice of issuing written notice immediately when any potential change is identified, even before the scope and pricing are fully developed. A notice that says "we are reviewing the following item as potential additional scope and will follow with pricing" protects your right to be compensated while you develop the full change order. That's a better position than waiting until everything is documented and discovering the notice window has closed.
