Terms & Conditions

These Terms & Conditions (“Agreement”) govern participation in the Stancon Affiliate Program (“Program”) offered by Stancon Consultants (“Stancon,” “we,” “our,” or “us”). By applying for or participating in the Program, you (“Affiliate,” “you,” or “your”) acknowledge and agree to be bound by this Agreement.
If you do not agree with any part of these terms, do not apply or participate in the Program.
1. Eligibility
To participate, you must:
1: Be at least 18 years old.
2: Provide accurate and complete registration information.
3: Have the legal authority to enter into contractual agreements.
4: Promote Stancon Consultant services in compliance with all local, national, and international laws.
Stancon Consultants reserves the right to accept or reject any application at its sole discretion.
2. Program Overview
The Program allows approved Affiliates to earn commission for referring qualified clients who purchase eligible Stancon services using the Affiliate’s unique tracking link.
This Program is for commercial concrete contractors and related business referrals, not for personal use.
3. Commission Structure
3.1 Commission Rate
Affiliates earn a one-time 15% commission based on the first completed and fully paid project of any new client they refer.
3.2 Commission Basis
Commission is calculated on:
The net project value
Excludes: taxes, fees, change orders, reimbursement costs, software fees, retainers, or any non-project-related charges.
3.3 Payment Timeline
Commission payments are processed within 30 days after:
The referred client completes their first project AND
Stancon receives and confirms cleared payment from the client.
3.4 Requirements for Payment
To receive payment, Affiliates must:
- Provide accurate payment information.
- Submit any required documentation (e.g., W-9 or equivalent).
- Maintain an active and valid account.
If incorrect payment details delay payout, Stancon is not responsible for missed or delayed payments.
4. Referral Qualification
A referral qualifies for commission only when:
1. The referral is a new client with no previous contact or active relationship with Stancon.
2. The client signs up through the Affiliate’s unique tracking link.
3. The client completes and fully pays for their first project.
4. No disputes, chargebacks, or refunds occur.
Stancon Consultants has final decision authority on whether a referral is qualified.
5. Client Ownership
All referred clients become the exclusive clients of Stancon Consultants.
Affiliates have no ownership or ongoing claim over:
- The client relationship
- Future revenue
- Subsequent projects or subscriptions
Affiliates are compensated only for the first completed project tied to their referral link.
6. Affiliate Conduct & Restrictions
Affiliates must conduct themselves professionally and ethically. Prohibited actions include but are not limited to:
- False, misleading, or exaggerated claims about Stancon services.
- Spamming, mass unsolicited messaging, or automated outreach.
- Misrepresentation of affiliation (e.g., posing as Stancon staff).
- Bidding on Stancon brand terms in ads.
- Creating websites or content that imitate Stancon branding.
- Offering unauthorized discounts, incentives, or guarantees.
- Engaging in fraudulent activity, including self-referrals.
Any violation may result in:
- Immediate termination from the Program.
- Loss of unpaid commissions.
- Legal action if damages occur.
7. Marketing & Promotion Rules
Affiliates may promote Stancon using:
- Social mediaEmail (permission-based)
- Networking channels
- Personal websites or blogs
Affiliates may not:
- Use deceptive marketing tactics.
- Use Stancon trademarks without written approval.
- Make claims inconsistent with Stancon’s official messaging.
Stancon reserves the right to request removal or correction of any promotional content.
8. Tracking & Attribution
Referrals are tracked using cookies and affiliate links.
8.1 Cookie Duration
Your link tracks a referral until the first project is completed, regardless of timeframe, provided:
- The client used your link at initial sign-up.
If a client clears cookies, uses a different device, or signs up through another link, attribution may not occur. Stancon is not liable for lost tracking due to technical factors outside its control.
9. Program Modifications
Stancon may modify, suspend, or terminate the Program at any time.
If changes affect commission structure:
- Affiliates will be notified via email.
- Commissions earned before modification will be honored.
Participation after an update constitutes acceptance of the revised terms.
10. Termination
Stancon may terminate an Affiliate’s participation immediately for:
- Violations of this Agreement
- Fraudulent behavior
- Unethical marketing
- Damage to Stancon’s reputation
Upon termination:
- All unpaid commissions unrelated to qualified referrals are forfeited.
- All promotional rights immediately end.
Affiliates may terminate participation at any time by emailing Stancon.
11. Limitation of Liability
Stancon is not liable for:
- Lost profits or commissions
- System errors, tracking failures, or technical issues
- Damages arising from participation in the Program
- Marketing or promotional claims made independently by Affiliates
The Affiliate participates at their own risk.
12. No Employment or Agency Relationship
Participation does not create:
- Employment
- Partnership
- Joint venture
- Agency
- Franchise
Affiliates cannot speak on behalf of, negotiate contracts for, or bind Stancon in any manner.
13. Confidentiality
Affiliates may receive non-public information about Stancon.
Such information must be kept confidential and cannot be shared without written permission.
14. Governing Law
This Agreement is governed by the laws of the State of Tennessee.
Any disputes shall be resolved exclusively in state or federal courts located in that jurisdiction.
15. Acceptance of Terms
By registering for the Stancon Affiliate Program, you confirm that you:
- Have read and fully understand these Terms & Conditions
- Agree to comply ethically and legally
- Accept that commissions are one-time payments based on the first completed project
If you do not agree, do not sign up or participate.
